Regulation (EU) No 2024/2748, adopted by the European Parliament and the Council on October 9, 2024 and published in the Official Journal of the EU on November 8, 2024, will be applicable as of May 29, 2026. The Regulation amends in parallel six key pieces of legislation in the field of building materials (305/2011), cable cars (2016/424), gas appliances (2016/426), general product safety (2023/988) and machinery (2023/1230), in particular the PPE Regulation (2016/425).
The backbone of the Regulation is the objective to ensure the rapid placing on the market of crisis-critical PPE during an internal market emergency mode activated under the Single Market Emergency and Resilience Act (IMERA) (EU) 2024/2747. Accordingly, a new chapter on emergency procedures is being added to the PPE Regulation 2016/425.
Three key provisions of direct relevance to Notified Bodies and manufacturers stand out: first, the obligation for conformity assessment bodies to prioritize applications for crisis-critical products over other applications; second, Member States may, upon justified request, exceptionally grant provisional authorization for the placing on the market of certain PPE before the normal conformity assessment procedures have been completed; third, a presumption of conformity may be given to products manufactured in accordance with EU, national or accredited international standards that the Commission determines provide equivalent protection. The Regulation also includes accelerated mechanisms for the adoption of common technical specifications and market surveillance; Notified Bodies will need to update their crisis internal procedures according to this new regime.
